4.2 Fees and Payment

Our fees vary based on the scope and complexity of each project. We may charge fixed fees, hourly rates, or a percentage of the project budget, as specified in your service agreement.

All invoices are due upon receipt unless otherwise specified. Late payments may incur additional fees and/or suspension of services.

4.3 Cancellation and Refunds

Cancellation terms are specified in your individual service agreement. Generally, deposits are non-refundable, and cancellation fees may apply depending on the project stage and resources already committed.

5. Intellectual Property Rights

5.1 Our Content

All content included on our website or created during our design process, including designs, drawings, specifications, and documentation, is the property of FINDMINE or its content suppliers and is protected by international copyright laws.

5.2 Client Usage Rights

Upon full payment for services, clients receive a non-exclusive, non-transferable license to use the final design deliverables for their intended purpose. FINDMINE retains the intellectual property rights and may feature the designs in our portfolio, unless otherwise agreed in writing.

5.3 Restrictions

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our content, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of the website for your personal, non-commercial use and not for further reproduction, publication, or distribution.

6. User Responsibilities

When using our Services, you agree not to:

  • Violate any applicable laws or regulations.
  • Infringe upon the rights of others, including intellectual property rights.
  • Submit false or misleading information.
  • Engage in any activity that could disable, overburden, or impair the functioning of our Services.

Our total liability for all claims related to the Services shall not exceed the greater of £100 or the amounts paid by you to FINDMINE during the twelve months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless FINDMINE, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

10. Termination

We may terminate or suspend your access to all or part of our Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
